This section supplements the information contained in our main Privacy Policy and applies to residents of California. This section covers the information and our activities subject to the California Consumer Privacy Act of 2018 , as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”).
For purposes of this section, the term “Personal Information” includes any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household, such as your real name, alias, postal address, unique personal identifier, online identifier Internet Protocol (IP) address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers. Personal Data, as used in this section, does not include publicly available information and other information that is regulated by certain applicable laws that are exempted from the requirements of the CCPA.

- Your Rights. Individuals residing in California have the following rights under the CCPA:
- Right to Know. You have the right to request that we disclose certain information to you about our collection of your Personal Information. You also have the right to request that we disclose certain information to you about our disclosures and sales of your Personal Information. Such information shall cover the 12-month period preceding our receipt of your request. Upon our receipt of your verified request, we will provide you with the following:
- The categories of Personal Information we have collected about you;
- The categories of sources from which we have collected your Personal Information;
- Our business or commercial purpose(s) for collecting or selling your Personal Information;
- The categories of third parties with whom we have shared your Personal Information;
- The specific pieces of Personal Information we have collected about you; and
- The categories of Personal Information that we disclosed about you for a business purpose and what Personal Information was shared and to whom.
- Right to Opt-Out. We do not sell or share Personal Information as defined in the CCPA. You have the right to opt-out of the sale or sharing of your Personal Information if we ever engage in such activities.
- Right to Delete. You have the right at any time to request that we delete your Personal Information. However, in some cases we may not delete all or some of your Personal Information to the extent required or permitted by applicable laws.
- Right to Correct. You have the right at any time to request that inaccurate Personal Information collected by us be corrected. However, in some cases, we may deny requests to correct inaccurate Personal Information, or may alternatively delete such Personal Information.
- Right to Non-Discrimination. We will not discriminate against you for exercising your rights under the CCPA. Further, we will not retaliate against you in any way for exercising your rights under the CCPA.
- Right to Know. You have the right to request that we disclose certain information to you about our collection of your Personal Information. You also have the right to request that we disclose certain information to you about our disclosures and sales of your Personal Information. Such information shall cover the 12-month period preceding our receipt of your request. Upon our receipt of your verified request, we will provide you with the following:
- Information We Collect. In the preceding 12 months, we have collected the below categories of Personal Data. For more details about the specific data points we collect, please see the “COLLECTION AND PROCESSING OF PERSONAL DATA AT AXCELIS” section of the main Privacy Policy above.
- Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers.
- Commercial information, including records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
- Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an internet website application, or advertisement.
- Our Sources for Information. We collect Personal Data from you when you provide it to us, when you use our website, when you purchase products and services from us, and when you interact with us. We also automatically collect some information when you visit our website. For additional details, please see the section of the main Privacy Policy entitled “COLLECTION AND PROCESSING OF PERSONAL DATA AT AXCELIS”.
- Our Business Purposes for Collecting Information. Please see the section of the main Privacy Policy entitled “COLLECTION AND PROCESSING OF PERSONAL DATA AT AXCELIS”.
- Sharing Information. We may disclose your Personal Data for the business or commercial purposes set forth in this Privacy Policy. For more details about our disclosures of Personal Data, please see the section of the main Privacy Policy entitled “SHARING OF PERSONAL DATA”. We have not sold Personal Data in the preceding 12 months. We do not use or disclose sensitive Personal Information except as set forth in our main privacy policy and as necessary to perform the Services as reasonably expected.
- Retention of Information. We retain Personal Data only for as long as is necessary for the purposes set out in our Privacy Policy. We will also retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your Personal Data to comply with applicable law), resolve disputes, enforce our agreements, and as otherwise described in our Privacy Policy.
- How to Contact us to Exercise Your Rights. To submit a request to exercise your “Right to Know” or “Right to Delete” or “Right to Correct” rights provided in this notice, please send an email to PrivacyNotice@axcelis.com or call us by phone at 978-787-4000 and ask for the General Counsel. You can also write to Axcelis Technologies, Inc., 108 Cherry Hill Drive, Beverly, MA 01915-1053, USA, Attention: General Counsel. We will evaluate the request and take action where required to do so. You privacy is important to us and we will make every effort to address your concerns.We will confirm receipt of your request within 10 business days and will provide information about how we will process your request. We endeavor to respond to your request as soon as we can, within the timeframes permitted under the CCPA. If we are not able to respond to your request within 45 days, we will let you know that we may require additional time (up to 90 total days). Please note that in most cases we may not respond to more than two “Right to Know” requests from the same individual in any 12-month period.
- Verification of Requests and Authorized Agents. We may have to verify your identity before processing your request. Our verification process may vary depending on the nature of your request. However, generally, we will verify your request by asking you to:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized agent; and
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm that the Personal Information relates to you. You may also use an authorized agent to exercise your rights on your behalf. If you wish to use an authorized agent to make a request on your behalf, unless you have provided the authorized agent with power of attorney, we may require that: (1) you provide your authorized agent signed permission to do so; (2) you verify your identity; and (3) you confirm that you have provided the authorized agent permission to submit the request. We may deny any request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.
