PRIVACY POLICY

Thank you for your interest in Axcelis Technologies (“Axcelis,” “we,” “us,” or “our”) and our products, services and employment and other work opportunities.  We take your privacy very seriously. This Privacy Policy is designed to inform you about our collection and use of your Personal Data.

  1. BASIC INFORMATION ON THIS POLICY AND ITS SCOPE
    1. Collection and Processing of Personal Data. This Policy is intended to provide information about how and when Personal Data is collected, processed or used by Axcelis in connection with our business, as well as in connection with our website and related platforms.
    2. Definition of Personal Data. “Personal Data” as used in this Privacy Policy means information that identifies, relates to, or can be used to identify a natural person.  If an applicable law or regulation requires a broader definition of Personal Data for a particular individual, Axcelis will apply that broader definition to any relevant information.  Axcelis endeavors to comply with all data privacy regulations applicable to us.
    3. Legal Rights Vary. The legal rights of individuals with respect to their Personal Data may vary depending on their specific jurisdiction and the specific laws that are applicable to such individuals.  Therefore, not all privacy rights described in jurisdiction-specific sections of this Privacy Policy will apply to individuals that do not reside in such jurisdictions.

2. COLLECTION AND PROCESSING OF PERSONAL DATA AT AXCELIS

This section of our Privacy Policy is intended to inform you of why, when and how we may collect and process your Personal Data.

    1. Personal Data that you Provide to Us. You may provide Personal Data directly to us when, for example, you place an order, provide us goods or services, or to apply for a job or become engaged as an employee or other type of worker at Axcelis.
    2. Business Relationships.  Customers, prospects, partners, vendors and suppliers may provide us with business contact information (such as name, business contact details, position or title of their employees, contractors, advisors and authorized users) for purposes such as contract management, fulfillment, delivery of products and services, provision of support, invoicing and management of the services or the relationship. Additionally, if you use our supplier portal, we collect your login credentials and other information to create your account.
    3. Employees and Other Service Providers.   We also collect Personal Data from job applicants, employees and other types of service providers which is used to undertake our processes to consider the entry into new relationships, to engage in mutually agreed relationships with such individuals, and to perform our obligations (including the delivery of compensation and benefits) to them as employees or as other service providers.   Where required by applicable law, we will provide a separate notice to you about how we collect and use your Personal Data in this context.
    4. Website Users. If you provide Personal Data via the Contact Us form on our website, or subscribe to our emails via the Stay Updated form on our website, we will use your Personal Data to respond to the inquiries received, to respond to your specific requests for information about our products and services, and to inform you of new products, promotions, and events that you may be interested in. If you provide your email, or other contact information to us in any context, we may use it to communicate with you  and to send you updates about our company and our products and services. If you wish to stop receiving marketing emails from us, you may unsubscribe at any time by following the link at the bottom of such communications.
    5. Technical Data Collected During Use of our Websites. When you access our website, we automatically collect certain information from your device. This includes the type of web browser, the operating system used, the domain name of the Internet service provider, the IP address of the computer used, the website from which you visit us, the pages you visit on our site and the date and duration of your visit. However, none of this data can be used by us to identify you. We only use this information to improve our website and the user experience.
    6. Aggregate Information. We may de-identify or aggregate information, including Personal Information, so that you are not identified as an individual, and use and provide that information to third parties without restriction. We may also provide aggregate usage information to third parties (or allow third parties to collect that information from you). However, we never disclose aggregate usage or de-identified information to a third party (or allow a third party to collect such information) in a manner that would identify you as an individual person.
  1. SHARING OF PERSONAL DATA
    1. No Sales. Axcelis does not sell, rent, or lease Personal Data.
    2. Transfers of Personal Data within the Axcelis Corporate Family. In order to fulfill our business, employment or other relationship with you, it may be necessary to transfer your Personal Data to other companies within the Axcelis corporate family (controlled by Axcelis Technologies, Inc., a Delaware, USA corporation). When that happens, the other organizations in the Axcelis corporate family will use your Personal Data in accordance with this Privacy Policy. Where possible, the scope of the transmitted data is limited to the required minimum.
    3. Service Providers. We use third party service providers to assist us with operating our business and providing our products and services, such as our technology vendors that help us maintain our products and services and our website, and third parties that assist us with our marketing and communication. These service providers may have access to your Personal Data in order to provide products and services to us, however, we only share Personal Data as necessary, and we contractually prohibit such service providers from using Personal Data for any purpose other than to provide products and services to us.
    4. As Directed By You and With Your Consent. Except as otherwise provided in this Privacy Policy, we share information with companies, organizations or individuals outside of Axcelis  only at your direction or when we have your consent to do so.
    5. Legal Proceedings. We may share information with third party companies, organizations, governmental authorities, or individuals outside of Axcelis if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:
      1. Meet any applicable law, regulation, subpoena, legal process or governmental request;
      2. Enforce a contract, including but not limited to any applicable Terms of Service, including investigation of potential violations thereof;
      3. Detect, prevent, or otherwise address fraud, security or technical issues; or
      4. Protect against harm to the rights, property or safety of Axcelis, our users, employees, customers or the public as required or permitted by law.
    6. Sale or Merger. We may share information about you as part of a merger, acquisition, or other corporate transaction. If Axcelis Technologies or any of its affiliates is involved in a merger, asset sale, financing, liquidation or bankruptcy, or acquisition of all or some portion of our business to another company, we may share your information, including your Personal Information, with that company before and after the transaction closes. In such a case, unless permitted or otherwise directed by applicable law, your information would remain subject to the terms of the applicable privacy policy in effect at the time of such transfer.

4. INFORMATION SECURITY

    1.   Axcelis uses reasonable technical and organizational security measures designed to protect your Personal Data. However, we cannot guarantee, ensure, or warrant the security of any Personal Data you transmit to us. There is no guarantee that Personal Data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. Also, it is your responsibility to protect the security of your login information, where applicable.

5. RESIDENTS OF THE EEA, SWITZERLAND, AND THE UNITED KINGDOM. Residents of the EEA, Switzerland, and the United Kingdom have additional privacy rights.  Information on these rights is provided in our supplemental European Economic Area, Switzerland and United Kingdom Resident Privacy Notice.

6. CALIFORNIA RESIDENTS. Residents of California have additional privacy rights. Information on these rights is provided in our supplemental California Resident Privacy Notice.

7. COOKIES AND ANALYTICS TOOLS

    1. We use so-called cookies in some areas of our external website. A cookie is a small text file that is placed on your hard drive by a website. Cookies do not cause any damage to your computer and do not contain any viruses. The cookies on our Internet pages do not collect any Personal Data. We use the information contained in cookies to make it easier for you to use our pages and to tailor them to your needs.We use both session cookies and permanent cookies on our site. Session cookies are temporary cookies that are stored in the user’s Internet browser until the browser window is closed and the session cookies are deleted. Permanent cookies are used for repeated visits and stored in the user’s browser for a certain period of time (usually 1 year or longer). These cookies are not deleted when the browser is closed. This type of cookie is used to recall a user’s preferences when returning to the site.

      All users may view our website without cookies. If you do not want cookies to be stored on your computer, you can deactivate the corresponding option in the system settings of your browser. You can delete saved cookies at any time in the system settings of your browser. You can find out how this works in detail from your browser manufacturer’s instructions. Our website may allow only limited use if cookies are disabled.

    2. Google Analytics and Google Tag Manager. Our website uses Google Analytics. At Axcelis’ request, Google evaluates aggregate use of the website in order to compile anonymous reports about the website activities and to provide Axcelis with additional services to enhance the effectiveness of Axcelis’ website.Google Analytics also uses cookies on this website. The information generated by the Google Analytics cookie is transferred to a Google server in the USA and stored there. You may refuse the use of cookies by selecting the appropriate settings on your browser. However please note that you may not be able to use the full functionality of our website once cookies are disabled. You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Google by downloading and installing the Browser-Add-on. If you click here, an opt-out cookie will be set to prevent future collection of your data when you visit this website: Deactivate Google Analytics.

      Axcelis uses the Google Tag Manager function. Google Tag Manager does not collect any Personal Data – the function makes it easier for Axcelis to integrate and manage our tags. Tags are small code elements used, among other things, to measure traffic and visitor behavior, to measure the impact of online advertising and social channels, to set up remarketing and targeting, and to test and optimize websites. We use the Tag Manager in conjunction with Google Services, Google Analytics and GA Audience. As noted above, you can deactivate this functionality (Google Tags, Google Services, Google Analytics and GA Audience) by deactivating Google Analytics. Deactivation of these functions may impact the responsiveness of our websites.

    3. Third Party Websites.  Our website may contain links to other websites and services operated by third parties, and may include social media features such as social media buttons or links. These third-party websites and services may collect information about you if you click on a link or visit those websites or services, and the social media sites may automatically record information about your browsing behavior every time you visit a website that has a social media button. Your interactions with these features and third parties are governed by the privacy policy of the third party, not by this Privacy Policy.
       
    4. Do Not Track. We do not currently recognize automated browser signals regarding tracking mechanisms, which may include Do Not Track instructions.

8. CHILDREN’S PRIVACY. Our website, products, and services are not directed at children under 16, and we do not knowingly collect information from children under 16. If you are under 16, please do not attempt to use our website or send any information about yourself to us.

9. CHANGES; COMMENTS AND CONTACTS

    1. Changes. We may update this Privacy Policy from time to time. When we do, the updated Privacy Policy will be posted on this page. We encourage you to read this page each time that you visit our website so that you will be aware of any changes, and your continued use of our website shall constitute your acceptance of any such changes. Changes to this Privacy Policy take effect from the date of publication, unless stated otherwise.
